1. Acceptance of terms

These Terms of Service ("Terms") govern your access to and use of Datyze (the "Service"), operated by [Legal entity name]. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Description of the Service

Datyze is a privacy-first, cookieless-by-default web analytics service. It lets you measure traffic on your websites, optionally attribute revenue, and embed public widgets. You are responsible for installing the tracker lawfully on websites you control and for choosing the appropriate privacy mode.

3. Accounts & registration

• You must provide accurate information and keep your credentials secure.
• You are responsible for all activity under your account and team.
• You must be at least 16 years old, or the age of digital consent in your country.

4. Acceptable use

You agree not to:

• Install the tracker on websites you do not control or are not authorised to track
• Use the Service to collect special-category or unlawful data
• Attempt to breach, overload, reverse-engineer or disrupt the Service
• Resell or sublicense the Service without our written permission

5. Plans, billing & refunds

• Free tier: available with usage limits, subject to change.
• Paid plans: Pro (€9 / month) and Business (€19 / month), billed through our payment provider, Lemon Squeezy. Prices are shown exclusive of any applicable taxes unless stated otherwise.
• Renewal: subscriptions renew automatically for the chosen period until cancelled. You can cancel at any time; access continues until the end of the paid period.
• Refunds: [Refund policy — e.g. 14-day right of withdrawal for EU consumers, save where the service has already been fully performed with your consent].
• Changes: we may change prices with prior notice; changes apply at your next renewal.

6. Intellectual property

The Service, its software and brand are owned by [Legal entity name]. We grant you a limited, non-exclusive, non-transferable right to use the Service under these Terms. You retain all rights to your own data and content.

7. Your data & data protection

Analytics data you collect through Datyze remains yours. Where Datyze processes personal data of your visitors on your behalf, we act as your processor under our Data Processing Agreement, which forms part of these Terms. Our handling of your account data is described in our Privacy Policy.

8. Service availability

We aim to keep the Service available but provide it on a best-effort basis, without a guaranteed service level unless agreed separately in writing. We may modify, suspend or discontinue features with reasonable notice where practicable.

9. Termination & suspension

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms, fail to pay, or use the Service unlawfully. On termination, your data is deleted in accordance with our Privacy Policy and DPA.

10. Disclaimers & limitation of liability

To the maximum extent permitted by law, the Service is provided "as is" without warranties of any kind. To the extent permitted by law, our aggregate liability for any claim arising out of the Service is limited to the amounts you paid us in the 12 months before the claim. Nothing in these Terms excludes liability that cannot be excluded by law, including consumers' statutory rights.

11. Governing law & disputes

These Terms are governed by French law. Subject to mandatory consumer-protection rules, disputes fall under the jurisdiction of the competent French courts. Consumers may also use the consumer mediation service referenced in our Legal Notice.

12. Changes to these Terms

We may update these Terms from time to time. We will post the new version here and update the "Last updated" date. Continued use after changes take effect constitutes acceptance.
